22.1 Background Checks Code; carbon monoxide detectors

Comments:
A monitoring inspection was completed on Wednesday, April 12, 2023. There were 64 children present, ranging in ages from infancy to 4 years, with 16 staff supervising and administrative staff on site. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special care and emergencies and nutrition. A total of 9 child records and 5 staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Violations:
Standard #: 22.1-289.058
Description: Based on interview, the center did not ensure to equip one carbon monoxide detector in a building that serves preschool age children.

Evidence: Interview with staff confirmed the carbon monoxide detector has been ordered but not installed in the building during the inspection.

Plan of Correction: The carbon monoxide detector has been purchase and center director will follow up on installation status.

Standard #: 8VAC20-770-60-C-2
Description: Based on review of staff records and interview, in 2 of 5 staff records the center did not ensure to obtain a central registry finding within 30 days of employment or volunteer service.

Evidence:
1. In Staff#4's record (date of hire: 08/01/2022), there was no central registry findings found.
2. In Staff#5's record (date of hire: 01/03/20230, there was no central registry findings found.
3. Interview with staff confirmed the central registry findings were not available for review during the inspection.

Plan of Correction: The center's director will utilize portal for submission of central registry searches and document all follow up with not received within 30 days.

Standard #: 8VAC20-780-160-A
Description: Based on review of staff record and interview, the center did not ensure each staff member submit documentation of a negative tuberculosis (TB) screening within the last 30 calendar days of the date of employment.

Evidence: In Staff#4's record (date of hire: 01/03/2023), the tuberculosis screening was dated 09/26/2021. Interview with staff confirmed the TB document available during the inspection.

Plan of Correction: The center's director will request staff to complete TB screening today and will obtain for staff record.

Standard #: 8VAC20-780-270-A
Description: Based on observation, the center did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition.

Evidence: In the Preschool 1 and Pre-K bathroom areas, there multiple areas where the sinks were visibly separating from the wall and unsecured.
In Pre-K the flooring was cracked in the back of the toilet area.
There was visible rusting on the attachments connected in the back of the toilets in both areas.

Plan of Correction: The center's director will contact owners for work orders for physical plant concerns.

Standard #: 8VAC20-780-280-B
Description: Based on observation, the center did not ensure hazardous substances are kept in a locked place using a safe locking method that prevents access by children.

Evidence: In Pre-K classroom, there was a cabinet observed unlocked containing multiple disinfectant cleaners and spray, and bathroom cleaners with the labels "keep out of reach of children" "warning" and "caution".

Plan of Correction: The center's director locked the cabinet immediately and will remind all staff to ensure to lock all hazardous substances.

Standard #: 8VAC20-780-530-A-2
Description: Based on staff records and observation, the center did not ensure a current certification in first aid within 90 days.

Evidence: In Staff #3's record (date of hire: 08/01/2022) there was no certificate of completion for first aid found. Interview with staff confirmed the first aid certificate of completion was not available during the inspection.

Plan of Correction: The center's director will notify staff to complete first aid training and to provide completion certificate once complete.
